So I overpaid for this...

$46 + shipping on these.  Seller had them listed as having "slight shelf wear".  Looked rather nice from the one pic each on this, so I threw down some bids.  I was sorely disappointed.

Please excuse the poor resolution on the later images.  My camera phone sucks, but you stil get the general idea on why I'm disappointed. image  I'm thinking about asking for a refund, especially on the DK3.

    I am extremely disappointed in the quality of the games you shipped to me. The pictures that you listed, along with your description of "slight shelf wear" does not account for the tears on the Kung Fu and Donkey Kong 3 boxes, nor the stickers on the Kung Fu Heroes box. Please see the attached pictures for what I am referring to if you do not remember.

    Now I am willing to be reasonable with this. The carts by themselves have a value of about $20, but the boxes are completely worthless. So if you will refund me the $25 difference, I will still leave positive feedback, and consider the matter settled. If not, I am prepared to leave negative feedback and file a complaint with ebay and paypal. I hope we can reach an agreement on this.   • Give him 24 hours then file a claim. Don't waste any time. BTW, was there delivery confirmation? You have more options if not.

    Yeah, because stealing from someone and lying about receiving them is a better way of doing it. I'm so sick of people that think this is a "good idea" for some reason. File a "not as described" dispute at least, but don't tell people to lie about receiving the items if the seller did not put any tracking on it.

    It forces the seller to either refund the buyer and have the merchandise returned, or refund the buyer without merchandise being returned. They can disagree with the claim, and PayPal decides based on the auction, but honestly, everyone views condition differently, so he/she may not have really thought about being as descriptive as possible with the items.

    Ripping people off is saying the item never arrived in the first place. There is a right and wrong way to go about doing this. You realize based on what you are telling him to do, anyone internationally can do that to a US seller unless an item is sent Express. That's why it's not a good idea to be mentioning this as an option because that's all we need are more people ripping everyone else off because of no tracking.

  • I have to agree. Opening up a claim for item not received is just plain shitty. There is a time and a place for that, and if it gets abused it will be taken from all buyers.
  • sad to say, but i did do this once when the seller sent my stuff to doug and his stuff to me... when doug and i shipped our stuff to each other and i opened my package, my $600+ worth of stuff was in shit shape when it was described as "GREAT" the fire and ice box was completely torn up... i mean, if you take a box and literally tear it apart. it was that bad. anyway, the dude refused to refund my money, so i ended up getting ALL of my money back through paypal, then i worked with the seller and sent him back an agreed-upon amount. i wasnt out to fuck him over, but i easily could have if i wanted to!!!
  • i'm just saying do that to be sure to get your money back. you can send the damn games back. i'm not saying do that and keep the games.
  • I plan to file a condition not as described claim, if and when it becomes necessary. As I stated in my email to him, I'm willing to be reasonable. No response yet, but if I don't hear from him by this time tomorrow, ebay will hear about and dude's gonna have some negative feedback.



    I totally agree about putting delivery confirmation on everything, lol. I know people that work for the post office, and they tell me some of teh shit that goes on there. If you knew half the stories I did, you wouldn't send anything anywhere!
  • Keep us updated. I have had this happen to me too many times. I am kind of a perfectionist when it comes to condition but I always ask before I bid to make sure a box is mint and still I get some shitty ones sometimes. Its aggrevating.
  • MAKE SURE that next time this happens, you make no mention of feedback. With the changes to the feedback system recently, sellers not being able to leave negatives, ebay is cracking down on feedback extortion from buyers. If he were to report you for your message to him, whether you are completely in the right or not, ebay could very well misconstrue this as you simply had second thoughts about paying this much for the items, and are now attepting to renegotiate the price at the cost of feedback. If you instead file this not as described in Paypal, you'll just be required to ship back with DC# for a full refund, you'll only be out the shipping you paid to send it back. Good luck.

You can see them as threats if you so choose, but there is a reason ebay has an Item Not as Described complaint process. I am very aware of the age of the games, and I'm sorry that I trusted your initial descriptions of "slight shelf wear" to not be completely honest. The pictures were not clear, as they did not show the tears on the boxes on the backs of the items, as I mentioned in my first email to you.



    Once the twenty dollards ($20.00) has been refunded, I wil consider this matter resolved.

    Lmao, I used to play Final Fantasy XI, and they used that same line all the time in various forums.  Must be a gamer thing in general.

    I just hope the guy doesn't take his sweet-ass time getting me my cash back.  I could use it to put towards better games image

    so now wait... $25 is not reasonable, but $20 is? hmmmm, that doesnt make much sense to me. also, i like the fact that this dude says his pics are clear as to the condition of the games... yep, they are clear. FROM THE FRONT, which is what the pics are of, the boxes look great, and they really do! he kind of neglected to mention anything about the backs though. yep, normal shelf wear can tear hangtabs off and completely tear up the back of another box! i sure hope my shelves dont do that to my games!!!

  • Probably the Screwbay fees. $5 potentially can mean alot when you are already getting screwed over.
  • I'm not screwing the guy over image  He clearly misrepresented the items listed.  If he had offered a refund and asked me to return the items, I would have done that.  This seemed like a simpler solution, so that's what I proposed.
  • I think by "screwed over" he meant the inevitable ebay fees.
