How to discuss fences with your Neighbor

I know right? Im reading all these responses like "its none of their business" and "you don't have to tell them anything" like damn you guys must be shitty neighbors.

What happened to the friendly heads up?
  • I would just put it up. I don't really think you need to say anything to either of them. The only exception would be if one or both of them already had a fence up. Then you should just casually ask if they would mind if you joined with their fence (not like they would care).
  • As long as it's on your land you really don't have to say much but if you're on good terms with them you probably should. Our neighbor wanted to put one up, which i'm for since his idiot wife won't stop their dogs from getting our yard, but once he saw how much it was that idea vanished. Personally i'd say to hell with a fence and use cinder blocks to make a wall around my entire yard.
  • All you need is beer. A lot of neighbours will help pay for half or help with the labour. You just have to ask, and bring beer.
  • OK, so I thought I would elaborate on the issue since so many of you have taken interest. Attached is a picture of what I'm talking about. Right now, my neighbor and I share a concrete block wall between yards. I don't know if its on my property or his, I doubt if he does either. Either way, I would prefer to just extend that wall up with some picket fence pieces across the top. The pic attached shows a before and after with my idea.
  • Since you don't know whose property it is on. It would be wise to at least give him the courtesy of asking him how he feels about it.

He might just say go ahead and put it up and you are good. He might even agree to pay for some of it if he feels the fence would be beneficial to him and you propose a split cost.

If he resists and you find the wall is actually on HIS property, which can be found out if you really want to. Then you would have to build a fence further onto your property in front of the wall.

I am no expert, but i believe that is how it works.
  • Depending on how long the wall has been there it would now be the property line if either of you wanted to mess with adverse possession (if by chance it is not on the original property line - but it may well be) . If both of you are happy with where it is that is pretty much the end of any concern where the property line really is. You could have a pin survey done to be sure - but those are not free. Since the wall is arguably both of yours you really should let your neighbor know what you want to do - my guess is any fencing company doing the work under those circumstances would want approval from both property owners in order to not get dragged into any possible weirdness (from their perspective).
