    Of course a repro of a game that already exists is illegal. What about hacks? Can they be considered transformative works and thus fair use? Genuinely curious, I don't care to buy any myself

    A hack would most likely fall somewhere along the lines of a derivative work - at best; similar to fan fiction - and subsequently the property of the copyright holder.  You would have to get in front of a federal judge to argue circumstantial Fair Use and you would have a very difficult time arguing it was transformative enough (Mario is still Mario in Super Mario hacks; you just moved the placement of some pipes and pits). So, probably illegal? All this is moot anyway, unless everyone dumped their own carts.
