Bait and Switch?

S: I messaged the guy with the MP2 and asked if the one in the pic was his copy and he said yes.



I recently opened cases against both parties asking for refunds from both, is there anything else i can do on ebay or is it just a waiting game now? And what do you guys think on these sellers; honest mistake or bait and switch? If its the later i want to recomened these sellers for the hall of shame.



Any coincidence they are both from CALI?

  • They are both obviously not the cart in the photos on their respective listings. The smash bros could be the seller using their own photo for stock purposes but seems like a stretch. I'm calling shenanigans on the mario party seller- the cart shown had a NFR logo on it. And they both look like hell. I'd file not as described on both of them.
  • UPDATE: The smash bro seller issued a full refund instantly, he was prob hoping i didnt give a shit or something, and promtly asked for me to return his item (so he can do it again i suppose)



    No message from Mr. Mario Party 2 yet.



    Can i recommend these guys for the hall of shame?

    I am sorry to hear you are disappointed, but I did not trick you into buying an item or as you said, "bait and trick." I will be getting in contact with ebay. The game is in working condition as stated and is in "ACCEPTABLE" condition, also stated in the auction. Here is the definition of acceptable according to ebay. "Acceptable: An item with obvious and significant wear but is still operational. May have tears or holes in VHS/DVD box. The video game instructions and box may not be included. See the seller?s listing for full details and description of any imperfections." (eBay) I also stated in the auction that there were some marks on the game.

    i had to send back a few items before and its not fun , but ebay did cover the shipping and postage fees

  • i sent to my gf (US address), NA member mrsjkenned5 , there was NO tracking so i could of been an ass like the seller and said i never got it.



    Both sellers are from cali so i find it very wierd :S and bought in the same week.

  • ya i keep saying how stating condition is fine, but putting a wrong picture is not, and he hasnt addressed that yet. If i do win and he pussy foots around this more he is getting my first negative :S

The game works and the condition of the game is "as described" in the auction. The auction clearly states the condition of the game. I'm sorry to hear you are disappointed, but my auction states no refunds. And since the item you purchased was clearly described in the auction I can not refund your money. I guess we let ebay handle it from here. And the elaborate explanation is ebay's own words, they state them in depth for times like these. "

  • Wow, amazing man i love you, just sent him that link And i kept trying to explain that to him but he was either dumb or he is a scammer saying how it does have retail value, after i talked about it being a not for resale cart....



    Also, if you guys search mario party 2 nfr in google, its the first picture which pops up.
  • Well, ebay refunded my $$$ via a courtesy refund, this is what the seller had to say:

    Its called marketing Mrs. Kennedy. Or "a foot in the door technique." The details are the selling points, pictures/ poster are what attract the viewers eyes. You should never buy something off of a picture. I am not a fraud you just don't no marketing. No scam, I clearly listed the item accurately and you over payed. Most Mario Party 2 games do not sell for 30 dollars lol. 20 something dollars is about average. You should realize your anxiousness to have a game caused you to over pay. And now your mad because you know you over paid. However at this point we both got what we wanted.

  • Marketing my ass, it's not marketing because you don't advertise to get sales, ebay brings them to you. You show pictures of the item you sell. What a dumbass.
  • Phone ebay and warned them of this guy and they filed a report for him and hopefully he wont be on much longer. besides the BS i got a free game, i bet ebay knew he scammed me and would rather have him keep the 30$ me get mine back and keep the game then have him scam someone else and cause this crap over again. I left him nasty feedback and the guy i called assured me that the seller will not be able to remove it.

    Yeah, gotta love ebay. Bought a bootleg fami cart off a crooked vendor a month back and got told it's either pay return shipping on a refund or eat shit.
