My biggest question with these things is, did Capcom get the OK from Nintendo do this with a Nintendo cartridge? Technically Capcom owns the game, but the game was designed for a Nintendo console, and they're redistributing cartridges manufactured by Nintendo. This is the same case as with the Mega Man remakes on the PS1; Nintendo didn't allow them to use the NES code, so they had to remake them from scratch.

As is the case with repros, Nintendo probably doesn't care if Capcom makes these cartridges, it's not like they're taking sales away from Nintendo
