tried to return a game and ebay decided against me
Bought a CIB game on eBay from what turns out to be a shady Seller.
1) paid for item immediately
2) Finally got a tracking number 3 days later
3) The day I asked where it was it got to the PO and scanned (8 days later).
5) It arrived yesterday and the box was in poor condition. The box had wear showing but there was a lot more hidden in his ONE pic.
6) Filed a case to return it but my downfall was a poor and simply worded reason why.
7) Seller responded noting what was shown in the pic. and won the case.
Pretty obvious the Seller was being very deceptive with his pic. I bought it anyway thinking it wouldn't be a problem with eBay if I needed to return it. I LOST
What are my options now? Although it can be done calling them on a phone is a huge problem for me.
I've got 3 other Sellers that I've witheld negative or neutral feedback from that I'm ready to take out my frustrations on because of this latest case.
GRRRR!!!!

What did you put for the reason in your case?
You can try and resell the game for what you paid if thats possible
a link would help, but don't blame other sellers from 1 bad experience it really isn't fair to them...
Here is the link:

Here's what went down in the complaint:
The other feedbacks I'm withoding are because of not using a box for shipping.
I specifically request one when I make my Paypal payment.
Usually I just let it slide and don't leave any feedback at all. I've also got one feedback pending where a Seller cancelled the sale on me and I had to buy the game 2 more times for more and in a lesser condition.
My frustration has been building.
I try to ask for more pictures usually, especially if its only one in the listing saves alot of headaches both ways.

I returned a game about a week before no problem for the same reason. So this is why I didn't bother to ask for better/more pics. Also why I didn't plead my case to eBay with a lot more detail.
I buy games to keep. Selling this item and just breaking even will be a pain in the neck.
Your only option is calling on the phone.
What did you put for the reason in your case?
I'm trying to put together an SNES Majesco Sales (Assembled in Mexico) CIB set just so I can scan everything and upload the pics to the NA SNES Database.

This.
It's not like the seller claimed it was mint and then hid a side that had a slash on it, sounds like they mentioned the box being worn and showed a pic to give you an idea.
Wouldn't it be much easier to ask for additional pics or description rather than repeated buying and returning? These don't sound like people that are knowingly running the drag on you, they sound more like people selling a box to people that just want a box without being too picky on condition.

Actually he did hide a side. The bottom has a LOT of wear that was deliberately hidden behind the tray/cart in the pic. The lower right corner has a big hole in it. Again had eBay not let me return a couple games earlier (one being very easy) I wouldn't have bought the game in the first place. I've just learned how hard you need to plead your case when you get deceived.
It was listed in "good condition" i didnt see a picture of the back of the box but as long as it doesn't have ripped cover artwork or looks like it was sat on its what you have to expect off your average "good" ebay listings. seller did note box has some wear. I wouldn't leave a negative given the circumstance but maybe be more careful or ask for some better pictures in the future to avoid a similar situation.
The bottom of the box was hidden in the pic because it's beat up pretty bad. I thought I was covered by eBay from previous experiences. This was the 3rd time within a week I've had to return games because pics didn't show enough. Why should returning this one be any different. If it wasn't for eBay allowing me to return games so easily a week before I would have asked for a lot more pics.
You'd be best off changing your mindset about buying. Do what you can to be comfortable with what you are buying before purchase, not after.
I know you said you want to scan it to submit to the DB but to me it sounds like you just want to return it after submitting, not cool if that is the case.

or just look for sellers who are already offering a return policy, so you don't have to keep opening not as described cases and can just request a return and pay return shipping and maybe a restocking fee.
Even if you are always in the right, you can still get a history as a "problem buyer" who abuses the system by opening lots of cases, leaving a buch of negative feedbacks, or just from sellers reporting you.
Also, 3 returns in a week? You're doing something wrong buddy. I buy games constantly and return less than that in a year.
3 games in 1 week? Why are you buying so many game that do not have enough pictures? Ask the seller for more pictures or pass on the game.

Because prior to this eBay keeps letting me return them.
The entire NA SNES Database is my collection which I still have. All scanned one by one by one person.... me. If I wanted to add pics to the Database I'd just steal them right off eBay or the Internet and not buy a bloody thing. I'm doing this at my own expense for FREE.

Huh? So you're saying let myself get taken advantage of and not file another claim?
If I buy a lot of games it's inevitable I'm going to have a lot of comnplaints
Let's say 10% are problems. If I buy 100 different games that's 10 complaints. Then there's the fact that all these complaints could come in bunches.
Bottom line is why is this "hobby" such a pain in the ass??!! Especially online.

Like I said, you could be in the right every time and it still doesn't matter. I had an account a few years ago where all of my neutral and negative feedbacks were removed with over 1200 transactions in one year and I only left 8 negs/neutrals, but one of them was a lawyer who complained to ebay how I slandered him because he didn't know how to pack. lol
I mean, the guy could have shown another pic of the wear, but he mentions it in the listing multiple times. If you're looking for mint games, avoid listings that say they have wear, because they probably aren't mint. I wouldn't fault the seller on this one.
Also, 3 returns in a week? You're doing something wrong buddy. I buy games constantly and return less than that in a year.
So you're saying ALL Sellers are honest ALL the time, and that I'm not allowed to complain more than 3 times a year?

He is not saying ALL sellers are honest. This listing mentions the wear, but it does not clearly show it since it only has 2 pictures. It is also the buyers responsibility to ask questions to clarify and avoid situations like this. If a seller refuses... well then they might be hiding something.
The other issue is that complaints as frequent as this indicate a much larger problem. The one I see here is a lack of questions on your end. Buying items with 1 picture alone can and will lead to headaches like this.
I recommend you start asking questions and asking for more pictures. It may not be the answer you are looking to hear, but it is what you should have been doing before buying.

I had 2 accounts where all I did was buy off eBay. Close to 5000 purchases and never ever welched on a sale but yet I still managed to get negative feedback. Even at 90% success that would be nearly 500 complaints. But yet I still somehow got both my accounts closed. I am soooo sick of this "hobby."

Yup. Back to square one.... again. There always seems to be a new way to get burned when buying/selling on eBay. This "hobby" will make anyone a nervous wreck.
I only need 3-4 (not including this game) to complete this Majesco set just so I can add it to the NA Database but this may be the straw that broke the Camels back. I am soooo tired of having to cover your ass
just PAY for this FRUSTRATION.

You could try calling them.
just remember, caveat emptor. You should have asked for more pictures...
He refuses to see this point.

Somebody watches too much Brady Bunch.
