eBay problem

I put in an offer on an item last nite approx 10pm I wake up and it was accepted at 6 this am. Great I pay by 8 after getting ready for the day and now at 1030 they process a refund and mention they are out of stock or cannot fulfill the order for another reason. It was a tougher to find complete nes game. Why accept an offer if you don't have the item? It can't be because they lost track of the items they have listed (less than 20). What's my recourse? Just deal with it or can eBay step in? Looking for advice.

  • Unfortunately there is no recourse, you cannot force them to send you the item. Just be glad they refunded you and move on as it really is not worth the headache.



    It might be possible they did a deal out if ebay, or you got backdoored...
  • If you got your $ back it really isn't a huge deal, just sucks that you didn't get the game. I once sold an item on eBay that I no longer owned and I just refunded $ to the buyer.
  • Ebay says when you bid on something you are entering a binding contract. That binding contract apparently is only binding on the buyer - a buyer doesn't pay, seller(s) complain, ebay will cancel the buyer's account. Seller reneges there is no process for buyer except to leave negative feedback - ebay will not investigate (well they might - they won't tell you if they do or not and if they do they won't tell what they did - wtf - actually means IMHO they can't be bothered to spend any time on your trivial problem). No evidence will sway them at all (which tells me they didn't look) - I had a case where I bought something and the seller resold 4 hours later (for the same price). (Item did sell as buyer and reneging seller left feedback.)
