To answer your questions, I did purposely not include Shrek due to it being the same as the Gamecube version, but YMMV and it may be worth mentioning as an aside. I personally do not consider it an exclusive just because it has a different title. You do have to draw a line somewhere, for instance Fatal Frame: Director's Cut did not count since Fatal Frame was released on PS2 and for the most part, they are the same game.
Top Spin was also purposely not included for the reason you mentioned. Games that start out 'exclusive' don't always stay that way, such as with 'timed exclusives' like Metal Gear Solid 2.
BUT ... totally forgot about the rest of the games you mentioned. So ... I guess this list is a start. If anyone wants to take another crack at a more complete 'XBox Exclusive' list, be my guest.
