Is this worthy of a negative or am I overreacting?

I'll keep it short and sweet.  I bought a semi-large N64 lot recently from one of those damn "iSoldIt" sellers.  His response time was very slow.  I asked a question the day the item was listed and he responded two or three days before it ended (7 day auction) so I knew right away it was going to be pain.  Nonetheless I won the auction.  I sent a message immediately after winning the auction stating that the game boxes were the single most important thing to me and I wanted the item packed well.  One day goes by, no response.  Two days, no response.  Three days, no response.  By now I've gotten the automated "iSoldIt" you must pay within 5 days message or you get an unpaid item strike.  This time I choose to pay and send yet another message stating "I'm going to pay, but if the boxes arrive damaged I'm not going to be happy and will follow up appropriately."

Naturally the boxes are MINT.  Well I get them in today and they are "mostly" good.  3 notable exceptions: No Mercy (who cares), Crusin USA (believe it or not I actually cared here, but it's not "valuable") and Mario 64.  No Mercy and Crusin USA had moderate to severe crushing, maybe a 6.5 to 7 / 10 condition and Mario was only dented somewhat, maybe an 8.  However, I bid high knowing this stuff was damn near 10/10 Mint and I paid for MINT games (also was charged $2.50 for mandatory insurance).

So #1 His communication is non-existant and #2 He didn't listen to me despite repeated messages.  Would it be a dick move to leave a negative or is that perfectly acceptable?  What do you guys think?

  • How did he ship the boxes? They look to be in fairly good shape.
  • That's the listing picture, not the received picture. The 12 game titles I didn't explicitly mention came out fine, they were at the top of the box. Then No Mercy, Crusin USA and Mario 64 were buried at the bottom and with controllers and the power supply on top of them.



    Box was plenty big, plenty of styrofoam and packing peanuts, but someone didn't think about how to place the items. It shouldn't be rocket science that heavy stuff goes on the bottom....
  • Well if he didn't respond in a reasonable time frame considering the fact that they are "professional" sellers and the fact they didn't properly pack the items. I would say that deserves a negative. But that would mean that the option for a partial refund is out the door. Although with the fact that the item wasn't theirs in the first place you would probably have a hard time recovering any money anyway.

  • I would give the seller a heads up that you are considering giving them negative feedback and list, very specifically, the issues that you have. If they try and make it right, give them better feedback. If nothing, give them a negative and be specific. Also, I would keep copies of all of your emails and consider a partial refund with paypal (assuming you used paypal). Take lots of pictures of the condition of the items as they arrived.
  • Just tell them you'll neg them if you don't get a reply within 2 days. That will be the true test, and they will porbably respond. If not, neg. If they do, see what they say.
  • A little late on this one... but if they do not want to respond to you, I would just file a PayPal claim as "items not as described", and see how it goes from there.



    If you didn't PayPal it, just leave negative. If they didn't want to help to start with, they probably wont now, and probably don't care to.
  • I WOULD NOT THINK TWICE ABOUT THIS, NEGATIVE ALL THE WAY and i would not feel bad about doing it either.

    I responded asking how he wanted to resolve the issue, no response after 48 hours. Left a negative and then get an email the very next day saying he wanted to know exactly what happened and apologized that I was unhappy (he also said my eBay messages were marked as spam, I don't believe that though). Long story short he gave me a partial refund of $15 and I revised my feedback to a positive since he did provide good customer service at the end.
  • Hahaha, so eBay's feedback system actually works.
  • its a shame it takes a negative to get responces from some of these loser e-bay sellers.
