Question on use of deadly force by military in the US

I'm having a discussion with a fellow mexican over this topic. Do the military have different rules on the use of deadly force against a civilian, than say, the police? He claims that if you tresspass a military facility, the soldiers can shoot to stop you from going further, even if you are not armed, or even if they do not suspect you are, or that you can represent an immediate danger to others.



He says that someone got shot in area 51 base, and some others in Guantanamo.



What is the case here? Any input will be appreciated.

  • Im not in the military so i cant claim first hand knowledge. But it has always been reported that is the case at area 51. So it might depend on the base and what/if they are working on top secret stuff

    Most of the time the military police take care of security on military property, and refer most other things to local police.

    Most people approaching Area 51 are spotted by a private security firm that patrols the perimeter and call the sheriff's department to actually apprehend trespassers. From what I've heard, that sheriff's office gets really torked off when they have to go all the way out there.

    I did, but everything was about the police, almost no mention or clear indication of what I'm asking.

     
  • There is 3 things the military does not mess around with. Rape, Revenge and murder. Overseas in war or at home. The military is here to preserve the freedom in America. To answer your hypothetical question about if you or your friend snuck onto a military base you probably wouldnt be percieved as an immediate threat to the base operations and actual military intervention 9 times out 10 wouldnt occur. As othere have stated the MP would/does handle most of those situations. Because you are a civilian you cant be held to the same standards as military personell and you would be turned over to the local authorities and dealt with through civilain court system. Now if you and your buddy came loaded for bear amd were trying to overtake the base then rest assured you would be dealt with in a timely, lethal manner.

    The other thing you have to remember is that soldiers aren't armed 24/7 on a military base. They have strict regulations on when and where they can handle their weapons, and tight protocols. Ask any soldier who has misplaced a weapon and how much shit they got in when the entire area went on lockdown until the weapon was found.



     
  • Normally there are signs posted, and when you do get to close and don't listen there is warning shots. At this point, if you still don't listen then the next few shots aren't going to be warnings...

    I'm happy to hear people's opinions on things such politics etc.
    When it comes to obscure facts I rely on primary sources. Unless the obscure facts are regarding video games, then I think NA is a good source. For something like this, I would contact an expert in law of I couldn't find the answer.

  • Having lived off and on near a military base in my past and having friends who were active duty there too, yes, they can shoot you if you are deemed to pose any kind of a threat. It is US government property, they are guards. If you rush the gate, jump any line whether it's a gate or just a sign in the sand, and you don't turn around when you're told to, they have a right to use force, including deadly force depending on what you're up to. So yeah, unlike cops, they have more leeway to end your existence.
  • trespassing anywhere in the usa carries a very good chance of getting shot by someone, probably legally
